I am using the same ein for 2 separate LLCs (NJ & CA) using the same name.

I have formed two LLCs; one residing in Calif and the other in NJ with registered agents in each state. I needed to know if these are considered separate entities for liability purposes. Thanks

Answer

How do two different LLCs have the same EIN?

Is one of the "LLCs" actually just a foreign qualification rather than a separate entity?

If you really formed two separate LLCs, one in each state, then their liabilities should be independent.

If one LLC is merely a foreign qualification of the other, then they are the same LLC for liability purposes.
